01These terms
These terms are an agreement between you and crisp ("we", "us"). They apply when you use the crisp website, the crisp app builder, and the apps we host for you (together, "crisp"). By creating an account or using crisp, you agree to them.
If you use crisp for a company or another organisation, you confirm that you can accept these terms for it, and "you" includes that organisation.
You must be at least 16 years old, and old enough to make a binding contract where you live, to use crisp.
02Your account
Give us accurate information when you sign up, and keep it up to date. Keep your sign-in details safe. You are responsible for what happens in your account, unless it happens because of a failure on our side.
Tell us immediately through our contact form if you think someone else has used your account.
03What crisp does
crisp builds and changes web apps from your instructions, using AI models. It runs the apps it builds so you can use them while you work, checks them, and can publish them to the internet for you.
AI models can make mistakes. crisp checks its work, but it cannot guarantee that an app is correct, complete, secure or fit for a particular purpose. Review and test your app before you or other people depend on it, especially if it handles money, health information or other sensitive data.
crisp is not legal, financial, medical or security advice, even when it describes how something works.
04What you own
You own your content: what you write to crisp, files you upload, the code crisp writes for you, the data in your apps, and the apps themselves. We do not claim any ownership of it. To the extent we have any rights in the output crisp produces for you, we give them to you.
You give us permission to store, copy, process and display your content only as needed to run crisp for you: to build and run your apps, to publish them when you ask, to keep versions, to provide support you request, and to keep crisp safe. This permission ends when you delete the content, except for copies we must keep by law or that remain in backups for a limited time, as our Privacy Policy explains.
You are responsible for having the rights to anything you give crisp, such as text, images, logos or data, and for making sure your use of it is lawful.
Output from AI models is not always unique. Another person may receive similar code or text. Your ownership covers your project, not general ideas or common code patterns.
05How we use AI models
To build your app, we send your instructions and the parts of your project the AI needs (for example code, error messages and the structure of your data) to AI model providers. They return the code and messages you see.
We choose providers whose terms do not allow them to train their models on the content we send. We do not use your private projects to train AI models. If this ever changes, we will ask for your permission first.
06Acceptable use
You may not use crisp, or any app you build or publish with it, to:
- Deceive people into giving passwords, payment details or personal information, including phishing pages.
- Copy or imitate the sign-in page, branding or interface of another company or service in a way that could make people think it is the real one.
- Impersonate a person or organisation, or mislead people about who runs your app.
- Distribute malware, or attack, probe or overload any system, including crisp.
- Send spam, or collect people's contact details to send it.
- Publish content that is illegal, that sexually exploits children, that promotes violence or terrorism, or that harasses or threatens people.
- Infringe someone else's copyright, trademark, privacy or other rights.
- Collect sensitive personal data, such as health or financial information, without a lawful basis and appropriate protection.
- Mine cryptocurrency, or run work unrelated to your app to use our computing resources.
- Get around usage limits, plan limits, spending limits, security checks or access controls, create several accounts to collect more free usage, or use another person's account without permission.
- Resell or provide access to crisp itself to others without a written agreement with us.
If we find an app or account that breaks these rules, we may take the app offline, stop a request, or suspend the account. Where it is safe and lawful, we will tell you why and give you a chance to fix the problem first. Report abuse through our contact form.
07Apps you publish
When you publish an app, you run it. You are responsible for it and for how it treats its users. If your app collects personal information, you need to tell your users how you use it, for example in your own privacy policy, and follow the law that applies to you.
For the personal data your app stores about its users, you decide how it is used and we process it on your behalf to host your app. We do not use it for anything else.
If you connect your own domain, you must have the right to use it.
08Plans, credits and payment
Plans and prices are shown on our Pricing page. Paid plans are billed monthly in advance and renew automatically until you cancel.
On the plan that uses your own Anthropic API key, Anthropic charges you for AI usage under your own agreement with them, and crisp charges only for building and hosting beyond the free monthly allowance, at the prices on the pricing page. You are responsible for your key and for what Anthropic charges you.
Each plan includes an amount of AI usage each month. One credit is one US dollar of usage. The monthly allowance resets on your billing date and does not carry over. Top-ups do not expire while your account is open.
Every request shows its cost as it runs and respects your spending limit. When crisp breaks something and fixes it in the same request, the repair is not charged.
Prices do not include taxes unless we say so. If we change the price of your plan, we will tell you at least 30 days in advance, and the change applies from your next billing period after that.
You can cancel at any time. Your plan stays active until the end of the period you paid for. We do not refund partial months, except where the law requires it, or where a request failed because of our error, in which case we refund that usage when you ask.
If a payment fails, we will tell you and try again. If it still fails, your account moves to the Free plan. Your projects are kept.
09Availability and changes to crisp
We work to keep crisp and your published apps available, but we do not promise that it will never be interrupted. We may need to pause parts of it for maintenance or security.
crisp will change and improve over time. If we remove a feature that you pay for, we will tell you in advance and, where it is fair, adjust your price or let you cancel with a refund for the unused period.
10Ending this agreement
You can stop using crisp and delete your account at any time from your settings.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if your account puts other people or crisp at risk. Unless the reason is serious abuse or a legal requirement, we will tell you first and give you at least 30 days to export your code and data.
The sections on what you own, disclaimers, limits of liability and general terms continue to apply after this agreement ends.
11Disclaimers
Apart from the promises we make in these terms, crisp is provided "as is". To the extent the law allows, we do not give any other promises or warranties, for example that crisp will meet every need you have or that AI output will be accurate.
12Limits of liability
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost business or lost data that you could have exported, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing affects the rights you have as a consumer that cannot be changed by contract.
13Claims about your apps
If someone makes a legal claim against us because of an app you published, or content you provided, in breach of these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows. This does not apply to consumers where the law does not permit it.
14Changes to these terms
We may update these terms. If a change is significant, we will email you at least 30 days before it takes effect. If you do not agree with the new terms, you can close your account before then. The date at the top of this page shows when they last changed.
15General
These terms, together with our Privacy Policy, are the whole agreement between us about crisp. If a part of them cannot be enforced, the rest still applies. If we do not enforce a part immediately, we can still enforce it later.
These terms are governed by the law of the place where crisp is established. If you are a consumer, you also keep the protection of the mandatory law where you live, and you can bring a claim in your local courts.
You may not transfer this agreement to someone else without our permission. We may transfer it as part of a merger or sale of the business, and we will tell you if that happens.
